By accessing or using AEOscope's AI visibility monitoring services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our platform and services.

2. Service Description

AEOscope is an Answer Engine Optimization (AEO) platform that helps you monitor and improve your brand's visibility in AI chatbot responses. Our services include:

• Prompt tracking: Monitor how AI models respond to queries relevant to your business
• Automated daily runs: Your prompts are automatically tested across AI models daily
• Visibility analysis: Track how often your brand appears in AI responses and calculate visibility scores
• Sentiment tracking: Monitor positive, neutral, and negative sentiment in AI responses about your brand
• Brand discovery: Automatically identify brands mentioned alongside yours in AI responses
• Historical trends: View visibility and sentiment trends over time

3. Account Terms and Responsibilities

When using our service, you agree to:

• Provide accurate account and website information
• Maintain the security of your account credentials
• Only monitor domains and websites you own or have explicit permission to track
• Comply with applicable privacy laws (GDPR, CCPA, etc.) when creating prompts
• Not attempt to circumvent usage limits or restrictions
• Use the service only for lawful purposes
• Not use prompts to generate harmful, illegal, or abusive content
• Not attempt to manipulate, jailbreak, or exploit AI models
• Comply with the terms of service of AI providers we use

4. Usage Limits and Fair Use

Your subscription plan includes specific limits. These limits vary by plan tier and may include:

• Prompts tracked: Maximum number of prompts you can create and monitor
• AI answers analyzed: Maximum number of AI responses analyzed per billing period
• Websites: Maximum number of websites/domains you can monitor

Current plan limits are displayed on our pricing page and in your account dashboard. Exceeding these limits may result in service restrictions. You may upgrade your plan at any time to increase limits.

5. Payment Terms

By selecting a paid plan, you agree to pay AEOscope the monthly or annual subscription fees indicated. Key payment terms:

• Payments are charged in advance for the subscription period
• Fees are non-refundable except as required by law
• We may change pricing with 30 days notice
• Failed payments may result in service suspension
• Taxes are your responsibility unless otherwise stated
• Annual plans offer discounts compared to monthly billing

6. Data Ownership and Intellectual Property

Regarding your data and content:

• Your prompts: You own the prompts you create. You grant us a license to use them solely to provide our service (sending to AI providers and analyzing responses).
• Extracted insights: You own the insights we extract from AI responses (sentiment scores, keywords, mentions, etc.).
• AI responses: AI model responses are owned by the respective AI providers (OpenAI, Anthropic, Perplexity) according to their terms. We store and analyze these responses to provide insights, but you must comply with the AI providers' terms of service.
• Our platform: AEOscope owns the analysis algorithms, processing logic, dashboard, and platform infrastructure.
• You can export your prompts, insights, and data at any time
• Data is deleted within a reasonable timeframe after account termination

7. AI Provider Terms and Limitations

AEOscope relies on third-party AI providers to generate responses. Important limitations:

• You must comply with the terms of service of AI providers we use when using our service
• AI providers may change their services, APIs, or terms at any time, which may affect our service
• AI responses are generated by third parties and we do not control their accuracy, completeness, or content
• We are not responsible for AI provider outages, API changes, or service discontinuation
• AI providers may log API requests according to their own privacy policies

8. Service Availability and Support

We strive to maintain high service availability but cannot guarantee 100% uptime. Service availability depends on our platform infrastructure, AI provider API availability, and network connectivity.

We provide support through email and help documentation. Support response times and channels may vary by plan tier.

9. Cancellation and Termination

Either party may terminate this agreement:

• You can cancel your subscription at any time through your account settings
• Cancellation takes effect at the end of your current billing period
• We may suspend or terminate accounts for violations of these terms or AI provider terms
• Upon termination, you lose access to the service and your data will be deleted within a reasonable timeframe
• No refunds are provided for partial subscription periods

10. Limitation of Liability

AEOscope provides the service "as is" without warranties. We are not liable for any indirect, incidental, or consequential damages arising from your use of our service, including but not limited to lost profits, data loss, or business interruption. We are not responsible for the accuracy, completeness, or content of AI-generated responses, which are provided by third-party AI providers.

11. Changes to Terms

AEOscope reserves the right to modify or replace these Terms at any time. We will notify you of significant changes via email or through our service. By continuing to use our service after any revisions become effective, you agree to be bound by the revised terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions. Any disputes will be resolved in the courts of Portugal.
